Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and CastAI (“CastAI,” “we,” “our,” or “us”) governing your access to and use of the CastAI platform, including the web application and the WhatsApp Business integration (collectively, the “Service”).

By creating an account, sending a message to our WhatsApp Business number, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

CastAI is an AI-powered casting assistant designed for film, television, and OTT casting professionals. The Service enables authorized users to:

  • Search, organize, and manage talent databases
  • Generate character breakdowns and casting briefs from scripts
  • Build shortlists, track pipelines, and share casting documents
  • Interact with a conversational AI agent via web or WhatsApp
  • Generate contracts and casting-related documents

3. Eligibility and accounts

You must be at least 18 years old and a professional working in or authorized to conduct business on behalf of an entertainment industry organization to use CastAI. By using the Service, you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or suspected security breach.

4. Acceptable use

You agree not to:

  • Use the Service to send spam, unsolicited promotional messages, or content that violates WhatsApp Business Platform policies
  • Upload talent data, personal information, or content you do not have the legal right to share
  • Attempt to gain unauthorized access to the Service, other users’ accounts, or related systems
  • Reverse engineer, decompile, or attempt to extract the source code of the Service or the underlying AI models
  • Use the Service to generate content that is defamatory, harassing, discriminatory, or infringes intellectual property rights
  • Resell, sublicense, or commercialize the Service without our prior written consent
  • Circumvent rate limits, usage quotas, or other technical restrictions we have implemented
  • Use the Service in any manner that violates applicable laws, including data protection and privacy laws

5. Talent data and consent

You are solely responsible for ensuring you have all necessary rights, consents, and legal bases to upload, store, and process actor information, audition videos, headshots, contact details, and other personal data relating to talent you manage on CastAI.

You represent and warrant that your use of the Service to process such data complies with all applicable privacy laws, including but not limited to the Information Technology Act, 2000 (India), the General Data Protection Regulation (EU), and the California Consumer Privacy Act (USA) where applicable.

6. AI-generated content

CastAI uses third-party large language models (including services from OpenAI and Anthropic) to generate casting suggestions, character analyses, and drafted documents. AI-generated output may contain inaccuracies, biases, or errors. You are responsible for reviewing, verifying, and exercising professional judgment before acting on any AI-generated content.

CastAI does not guarantee the accuracy, completeness, or suitability of AI-generated output for any particular casting decision, contract, or business purpose.

7. WhatsApp Business integration

The WhatsApp integration is provided through Meta’s WhatsApp Business Platform. Your use of the WhatsApp channel is also subject to Meta’s WhatsApp Business Terms and WhatsApp Business Messaging Policy. Conversations you initiate with our WhatsApp number are processed to provide the requested casting assistance.

You acknowledge that WhatsApp messaging is subject to Meta’s 24-hour customer service window for free-form replies, and outbound notifications outside this window may use pre-approved message templates.

8. Fees and payment

Access to CastAI may be provided on a free, trial, or paid subscription basis depending on your agreement with us. Fees, if any, will be communicated at the time of sign-up or via a separate written agreement. All fees are non-refundable except as required by applicable law.

9. Intellectual property

The Service, including all software, design, text, graphics, and underlying AI models, is owned by CastAI or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non- exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You retain ownership of the data you upload (talent profiles, scripts, production data). By uploading data, you grant us a limited license to process, store, and display that data solely for the purpose of operating the Service on your behalf.

10. Privacy

Our collection and use of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON- INFRINGEMENT. CASTAI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AI-GENERATED OUTPUT IS PROVIDED FOR INFORMATIONAL AND PROFESSIONAL ASSISTANCE PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTAI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD 100).

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will continue to apply.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

15. Changes to these Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes will be communicated via email or a prominent notice in the application. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
